Product & Membership Terms and Conditions

1. About These Terms
These Product & Membership Terms and Conditions ("Terms") are issued by Speak About Speech Pathology Pty Ltd (ACN 616 142 379) trading as Successful Speechie Academy ("Successful Speechie Academy", "SSA", "we", "us" or "our").
These Terms apply when you purchase or access a paid product, course, training program, digital resource or membership offered by Successful Speechie Academy through www.SuccessfulSpeechieAcademy.com, our checkout pages, member portal or associated platforms ("Products and Services").
These Terms include specific provisions relating to membership in the Preschool Language Accelerator™ ("PLA").
By completing a purchase and accepting these Terms at checkout, you agree to be bound by them.
Our Website Terms and Conditions of Use apply to your general use of our Website.
Our Privacy Policy explains how we collect, use and handle personal information.
2. Your Purchases
When you purchase a Product or Service, you agree to pay the price displayed at checkout.
The description, inclusions, price, access period and payment arrangements displayed at checkout at the time of purchase form part of your agreement with us.
Prices are displayed in Australian dollars unless otherwise stated. GST will be charged where applicable and will be identified as part of the purchase process.
You must provide accurate and current information when making a purchase.
After payment is successfully processed, you will generally receive electronic access to the relevant Product or Service, including through the Successful Speechie Academy member portal where applicable.
3. Individual-Use Licence
Unless we expressly state otherwise at the time of purchase, each purchase is for one individual user only.
Your purchase does not provide a clinic, employer, team, university, organisation or other person with a licence to access or use the Product or Service.
Your account and login details are personal to you and must not be shared.
If another Speechie, clinician or team member wishes to access Successful Speechie Academy training or resources, they must purchase their own access unless Successful Speechie Academy has expressly agreed to a separate team or organisational licensing arrangement.
4. Permitted Clinical Use
We want Speechies to be able to use Successful Speechie Academy resources in the way they are intended to be used.
If a resource is designed for use with clients, you may download, print and use that resource with your own clients as part of your own clinical practice, subject to any instructions or restrictions accompanying the resource.
This may include, where appropriate, providing a client, parent or caregiver with a copy of a resource specifically designed to be used or taken home by that client, parent or caregiver.
This permission does not give you the right to distribute Successful Speechie Academy materials more broadly.
Unless we expressly give you permission, you must not:
- share your login or member portal access with another person;
- share purchased downloads or resources with colleagues or other clinicians;
- upload resources to a clinic, workplace, university, organisation or team shared drive;
- upload resources to a shared resource library, database or online platform accessible by other professionals;
- reproduce or distribute resources for use by other clinicians;
- purchase one copy on behalf of a clinic or team for multiple people to use;
- sell, resell, sublicense or commercially distribute our resources;
- remove our branding, copyright notices or other proprietary notices;
- rebrand our materials as your own;
- substantially copy, adapt or reproduce our materials to create your own training, course, resource library or competing commercial product; or
- otherwise exploit our intellectual property outside the licence granted under these Terms.
5. Intellectual Property
Successful Speechie Academy and/or its licensors retain all rights, title and interest in the intellectual property contained in our Products and Services.
This includes, without limitation:
- training videos and audio;
- written training materials;
- clinical frameworks and methodologies;
- therapy models and systems;
- hierarchies and diagrams;
- templates;
- handouts;
- worksheets;
- downloads;
- assessment and therapy resources;
- presentations;
- graphics;
- course structures;
- member portal content; and
- other educational materials.
Your purchase gives you a limited, non-exclusive, non-transferable licence to access and use the Product or Service in accordance with these Terms.
It does not transfer ownership of our intellectual property to you.
The licence granted to you is limited to your personal professional education and the permitted clinical use described in section 4.
PART A - PRESCHOOL LANGUAGE ACCELERATOR™ MEMBERSHIP
6. About PLA Membership
The Preschool Language Accelerator™ ("PLA") is an ongoing professional education membership for Speechies.
PLA provides professional education, clinical training, practical teaching strategies, resources and other materials designed to support preschool language assessment, therapy and clinical reasoning.
The inclusions available to you depend on the PLA membership option you purchase. The inclusions displayed on the relevant sales and checkout page at the time of your purchase form part of your membership.
Certain features may only be available with particular membership options.
In particular, Clinical Thinking Hub access is included with the standard PLA Annual Membership and is not included with the standard PLA Monthly Membership, unless we expressly state otherwise as part of a particular offer.
We may update and develop PLA content over time, including by adding, updating, replacing or retiring particular training, resources or features.
We will not materially reduce the core nature or value of the membership option you have already paid for without a reasonable basis.
PLA is designed to support professional learning and clinical reasoning. It does not replace your own professional judgement, assessment, supervision, scope of practice or professional obligations.
7. PLA Monthly Membership
The standard PLA Monthly Membership is currently $47 plus GST per month.
Minimum initial commitment
PLA Monthly Membership has a minimum initial commitment of three months.
By purchasing a Monthly Membership, you agree to pay the monthly membership fee for a minimum of three consecutive months, unless:
- you exercise the 7-Day PLA Guarantee under section 10; or
- you are otherwise entitled to cancel or receive a remedy under Australian Consumer Law.
At the current standard membership price, the minimum amount payable for the initial three-month commitment is $141 plus GST.
Your first payment is charged when you join. Subsequent monthly payments are charged using your nominated payment method in accordance with the billing schedule presented at checkout.
After the initial three months
After completing your initial three-month commitment, your membership continues on a month-to-month basis at the applicable membership fee until you cancel.
There is no new minimum commitment after the initial three-month period.
You may then cancel in accordance with section 9.
The standard PLA Monthly Membership does not include access to the Clinical Thinking Hub unless this is expressly included in the particular offer you purchase.
8. PLA Annual Membership
The standard PLA Annual Membership is currently $470 plus GST, paid upfront.
Your Annual Membership provides 12 months of access to the PLA Annual Membership inclusions described at checkout at the time of purchase.
The standard Annual Membership includes access to the Clinical Thinking Hub during your paid annual membership period.
The Annual Membership is currently priced to provide 12 months of membership for the equivalent price of 10 months of the standard $47 plus GST Monthly Membership.
The PLA Annual Membership does not automatically renew.
At the end of your 12-month membership period, your membership and access will end unless you actively renew or purchase another membership.
If you decide you no longer wish to use PLA during your annual membership period, you will continue to have access until the end of the period you have already paid for.
We do not provide a pro-rata change-of-mind refund for the unused portion of an Annual Membership.
This does not affect your rights under the 7-Day PLA Guarantee or Australian Consumer Law.
9. Cancelling PLA Monthly Membership
During the initial three-month commitment period, you remain responsible for the three monthly membership payments unless the 7-Day PLA Guarantee applies or you have another right to cancel under applicable law.
Once you have completed the initial three-month commitment, you may cancel your Monthly Membership at any time by:
- cancelling through your account in Kajabi, where that option is available; or
- emailing [email protected] and requesting cancellation.
Cancellation prevents future membership charges after the cancellation takes effect.
If you cancel after a monthly payment has already been processed, you will ordinarily retain access until the end of the period covered by that payment. That payment will not be refunded simply because you have changed your mind.
We recommend cancelling before your next scheduled payment date if you do not want the next monthly payment to be processed.
Nothing in this section limits your rights under Australian Consumer Law.
10. 7-Day PLA Guarantee
We want you to have the opportunity to determine whether PLA is right for you.
If you purchase a PLA Monthly or Annual Membership and decide it is not right for you, you may request a full refund within 7 days of your initial purchase.
To use the guarantee, email [email protected] within 7 days of your initial purchase and request cancellation and a refund.
If your request is made within the 7-day period:
- your PLA membership will be cancelled;
- your access to PLA will end;
- your initial PLA payment will be refunded; and
- if you purchased the Monthly Membership, you will be released from the remainder of the three-month minimum commitment.
The 7-Day PLA Guarantee applies to the initial purchase of a PLA membership. It does not apply to subsequent monthly payments or a later renewal or repurchase unless we expressly state otherwise.
This guarantee is in addition to, and does not replace, any rights you may have under Australian Consumer Law.
PART B - OTHER SUCCESSFUL SPEECHIE ACADEMY PRODUCTS
11. One-Off Digital Products and Courses
Successful Speechie Academy also sells one-off digital products, courses, toolkits, templates, resources and other educational materials.
Unless expressly stated otherwise at checkout, payment for a one-off Product is due in full at the time of purchase.
Because digital access is generally provided immediately after purchase, we do not provide change-of-mind refunds once digital access has been supplied, unless a specific guarantee or refund offer was expressly provided for that Product at the time of purchase.
This does not limit your rights under Australian Consumer Law.
12. Product Access
The access period for a Product or Service will be as described at the time of purchase.
Some Products may provide ongoing access, while others may only be available for a specified period.
Where no specific access period is stated, we will provide access for a reasonable period having regard to the nature and price of the Product.
We may occasionally need to migrate Products between platforms, update content or replace outdated materials.
Where reasonably practicable, we will endeavour to avoid unnecessarily disrupting your access to Products you have purchased.
PART C - MEMBER PORTAL AND PROFESSIONAL USE
13. Your Accout
Where a Product or Service includes access to a member portal, you are responsible for maintaining the security of your account and password.
You must:
- keep your login details confidential;
- not allow another person to use your account;
- provide accurate account information;
- keep relevant account and payment information reasonably up to date; and
- notify us if you become aware of unauthorised access to your account.
We may suspend access where we reasonably believe an account is being shared, compromised or used in breach of these Terms.
14. Failed Payments
If a recurring PLA Monthly Membership payment fails, we or our payment provider may attempt to process the payment again.
If payment remains outstanding, we may suspend your access to PLA until the outstanding amount is paid.
We will not knowingly continue charging you after a valid cancellation has taken effect.
You remain responsible for amounts properly due under your initial three-month minimum commitment, subject to the 7-Day PLA Guarantee and your rights under applicable law.
15. Clinical Thinking Hub and Case Discussions
Certain Successful Speechie Academy membership options, including the PLA Annual Membership, may include access to the Clinical Thinking Hub.
Your access to the Clinical Thinking Hub depends on the Product or membership option you have purchased and the inclusions stated at checkout.
The Clinical Thinking Hub allows eligible members to submit clinical questions or scenarios and access professional discussion and educational support relating to clinical reasoning.
You must not submit information that identifies, or could reasonably identify, a client or other person.
You are responsible for appropriately de-identifying any clinical scenario before submitting it and for complying with your own professional, ethical, confidentiality, privacy, workplace and consent obligations.
Clinical Thinking Hub responses and discussions are provided for general professional education and clinical reasoning support.
They do not constitute an assessment of an individual client and do not replace your own clinical judgement, assessment, professional supervision or other professional obligations.
By submitting a question or de-identified scenario, you permit Successful Speechie Academy to use, reproduce, discuss and retain the de-identified content for the purpose of operating the Clinical Thinking Hub and providing related professional education within Successful Speechie Academy.
We will not intentionally publish identifying client information supplied through the Clinical Thinking Hub.
16. Member Conduct
When participating in member areas, communities, discussions or other interactive SSA services, you must behave professionally and respectfully.
You must not:
- harass, threaten, abuse or discriminate against another person;
- publish defamatory, unlawful or offensive material;
- send unsolicited promotional or commercial communications to other members;
- infringe another person's intellectual property, confidentiality or privacy rights;
- collect member contact details for marketing or solicitation;
- post advertising, affiliate links or commercial promotions without our permission; or
- use member areas for an unlawful purpose.
We may remove content or restrict access where reasonably necessary to enforce these Terms, protect other members or comply with law.
17. Suspension or Termination for Breach
We may suspend or terminate your access to a Product, membership or member portal if you materially breach these Terms.
Where the breach can reasonably be remedied, we will generally give you an opportunity to remedy it before permanently terminating your access.
However, immediate suspension or termination may be appropriate where there is serious misconduct, including deliberate intellectual property infringement, account sharing, unlawful conduct, serious confidentiality or privacy breaches, fraud or conduct creating a material security risk.
Any action we take under this section will be proportionate to the circumstances.
Termination for your material breach does not automatically entitle you to a refund.
Nothing in this section limits rights or remedies available under applicable law.
18. Professional Education Disclaimer
Successful Speechie Academy provides professional education and general clinical information.
Our Products and Services do not provide individualised clinical, medical, legal or other professional advice for a particular client.
While we aim to provide practical, evidence-informed and current professional education, clinical evidence and professional practices can change over time.
You remain responsible for:
- conducting appropriate assessment;
- exercising your own clinical reasoning and professional judgement;
- determining whether a strategy, resource, framework, goal or recommendation is appropriate for an individual client;
- obtaining professional supervision where appropriate;
- practising within your competence and scope of practice;
- complying with relevant professional and ethical requirements; and
- complying with applicable laws, workplace policies, privacy requirements and consent obligations.
Successful Speechie Academy does not guarantee a particular clinical outcome for any client or a particular professional, employment, business or financial outcome for you.
19. Certificates and Professional Development
Where we provide a certificate of completion or record of participation, it confirms completion or participation in the relevant Successful Speechie Academy education as described.
Unless we expressly state otherwise, a certificate does not represent registration, accreditation, endorsement or certification by a professional regulatory body or external organisation.
You are responsible for determining whether particular Successful Speechie Academy education satisfies any continuing professional development requirements applicable to you.
20. Third-Party Platforms
We use third-party providers to deliver aspects of our Products and Services.
These may include Kajabi for website, checkout and member portal functionality and third-party payment processors.
We do not control every aspect of those third-party platforms and cannot guarantee that they will operate without interruption.
You may also be subject to the relevant third party's terms and privacy practices when using their services.
Where a temporary third-party outage occurs, we will take reasonable steps within our control to restore or facilitate access.
21. Changes to Products and Membership Content
Professional education develops over time, so we may update our Products and membership content.
This may include updating, replacing, reorganising or retiring lessons, resources, frameworks, downloads, features or other content.
We may also add new content or change the way content is delivered.
Where a particular feature or inclusion was expressly included with the membership option you purchased, we will not materially remove that inclusion during your paid membership period without a reasonable basis and, where required by law, an appropriate remedy.
We will exercise our right to update content reasonably and will not use it to materially deprive you of the core Product or Service you purchased during a paid access period.
22. Pricing Changes
We may change the price of Products or future membership periods from time to time.
A price change will not retrospectively change the price of a one-off Product you have already purchased.
For PLA Monthly Membership, we will give reasonable advance notice of a price increase before it applies to a future monthly billing period.
If you do not wish to continue at the new price after completing any applicable minimum commitment, you may cancel before the new price takes effect.
An Annual Membership price change will only apply if you later choose to purchase or renew another Annual Membership.
23. Promotions and Discount Codes
From time to time we may offer promotions, bonuses, introductory prices or discount codes.
Unless expressly stated otherwise:
- promotions apply only during the advertised promotional period;
- discount codes cannot be exchanged for cash;
- promotions cannot be retrospectively applied to previous purchases; and
- different promotions may have different eligibility requirements.
A later promotional price does not entitle an existing purchaser to a refund of the difference.
24. Australian Consumer Law
Our Products and Services come with rights and guarantees that cannot be excluded under the Australian Consumer Law where that law applies.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
Our change-of-mind refund rules and the 7-Day PLA Guarantee operate in addition to your statutory rights.
If a Product or Service fails to comply with an applicable consumer guarantee, you may be entitled to a remedy under Australian Consumer Law depending on the circumstances.
25. Limitation of Liability
To the maximum extent permitted by law, Successful Speechie Academy is not liable for indirect or consequential loss, loss of profit, loss of revenue, loss of opportunity or loss of goodwill arising from your use of a Product or Service.
You acknowledge that professional and clinical outcomes depend on circumstances beyond our control and that you remain responsible for your own professional decisions and use of the information provided.
Where our liability cannot lawfully be excluded, it will be limited only to the extent permitted by law.
Nothing in these Terms excludes or limits liability or remedies that cannot legally be excluded or limited, including applicable rights under Australian Consumer Law.
26. Indemnity
To the extent permitted by law, you agree to indemnify Speak About Speech Pathology Pty Ltd and its officers, employees and contractors against loss, liability or reasonable costs arising directly from:
- your unlawful use of a Product or Service;
- your material breach of these Terms;
- your unauthorised sharing, copying, distribution or commercial use of our intellectual property;
- information or content you submit in breach of another person's privacy, confidentiality or intellectual property rights; or
- your use of our Products or Services outside the licence granted under these Terms.
Your liability under this section will be reduced to the extent that our acts or omissions contributed to the relevant loss.
27. Privacy
We handle personal information in accordance with our Privacy Policy and applicable privacy laws.
The Privacy Policy explains how information may be collected through our Website, checkout, member portal, forms, communications and other interactions with Successful Speechie Academy.
You must not provide us with another person's identifiable clinical or personal information unless you are legally permitted to do so and it is reasonably necessary for the relevant interaction.
In particular, Clinical Thinking Hub submissions must be appropriately de-identified as described in section 15.
28. Events Outside Our Reasonable Control
We are not responsible for delay or failure to perform an obligation where this results from circumstances outside our reasonable control, including significant technology failures, internet outages, natural disasters, government action or failure of essential third-party infrastructure.
This does not excuse obligations that can reasonably continue to be performed and does not limit any rights you have under applicable law.
29. Changes to These Terms
We may update these Terms where reasonably necessary to reflect changes in law, technology, our Products and Services or our business practices.
Changes will be published with an updated revision date.
For an existing paid membership or Product, we will not rely on a change to these Terms to materially disadvantage you during a period you have already paid for unless the change is reasonably necessary, including to comply with law, protect security or address a genuine operational requirement.
Where a material change affects an ongoing membership, we will provide reasonable notice where practicable.
30. Disputes and Complaints
If you have a concern about a Product, payment, membership or these Terms, please contact us first so that we have an opportunity to resolve it.

We will endeavour to deal with complaints reasonably and in good faith.
Nothing in this section prevents either party from exercising a legal right, seeking urgent relief or accessing a court, tribunal, regulator or dispute resolution process where they are entitled to do so.
31. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
Subject to any rights available to you under applicable law, the parties submit to the jurisdiction of the courts of New South Wales and courts entitled to hear appeals from those courts.
32. Severability
If any part of these Terms is invalid, unlawful or unenforceable, that provision will be read down to the extent necessary or, if it cannot be read down, severed.
The remaining provisions will continue to operate.
33. Entire Agreement
These Terms, together with the information provided to you at checkout and any additional terms expressly identified as applying to your purchase, form the agreement between you and Successful Speechie Academy regarding the relevant Product or Service.
If there is an inconsistency between these Terms and specific written terms provided at checkout for a Product, membership option or promotion, the specific checkout terms will apply to the extent of the inconsistency.
Nothing in this section excludes representations or rights that cannot lawfully be excluded.
